The website presents the activities, services and editorial content of Elinora Luxury Real Estate, SASU. It is an information and introduction platform.

It constitutes neither an offer to sell or let, nor a public solicitation of investment. No brokerage service arises from use of the website alone: every engagement is subject to a separate written mandate compliant with French law no. 70-9 of 2 January 1970.

The website is freely accessible to any user with an internet connection, at their own cost. Elinora Luxury Real Estate endeavours to provide continuous access without being obliged to do so and may suspend access for maintenance, security, technical evolution or force majeure.

Certain sections, including the member area, are reserved for persons invited by Elinora Luxury Real Estate. Access is personal, confidential and non-transferable.

You are responsible for the confidentiality of your credentials and for all activity carried out from your account, and undertake to report any unauthorised use without delay. The maison may suspend access in the event of a breach of these terms.

You undertake not to circumvent security or authentication mechanisms, not to introduce malicious code, not to systematically extract or reuse website content or databases, not to exploit content for commercial purposes without written authorisation, not to send unsolicited approaches through the forms, and to comply with French law and public order.

Any breach may result in suspension of access and, where appropriate, legal proceedings.

Information is published for guidance only and may be modified or withdrawn without notice. Descriptions, imagery, surface areas, availability and financial terms do not constitute a firm offer within the meaning of article 1114 of the French Civil Code.

Imagery may include atmospheric photographs. The definitive terms of any transaction appear exclusively in the contractual documents signed between the parties.

The services of the maison are governed by the written mandate signed with the client, which sets out their scope, duration, fees inclusive of all taxes and the party bearing them.

The fee schedule is displayed at the office and provided on request, in accordance with the French order of 10 January 2017.

Where a contract is concluded at a distance or off-premises with a consumer, the consumer has fourteen days to withdraw without reason or penalty, in accordance with articles L.221-18 et seq. of the French Consumer Code. A standard withdrawal form is attached to the contract.

If the consumer expressly requests performance of the service before the end of that period, they remain liable for the service provided up to withdrawal; full performance of the service with their prior express agreement and express waiver results in the loss of the right of withdrawal.

These provisions do not apply to professional clients.

Personal data collected through the website is processed in accordance with our Privacy Policy and Cookie Policy, which form an integral part of these terms.

All elements of the website — texts, photographs, videos, logos, trademarks, visual identity, layouts, graphics, icons, illustrations, software and design elements — are the exclusive property of Elinora Luxury Real Estate or its licensors and are protected by the French Intellectual Property Code.

Any reproduction, representation, adaptation, extraction or exploitation, in whole or in part, is prohibited without prior written authorisation.

Elinora Luxury Real Estate acts as an intermediary and adviser and is bound by an obligation of means. It cannot be held liable for indirect damage resulting from use of the website or from decisions taken on the basis of published information.

Nothing in these terms limits the liability of the maison in the event of gross negligence or wilful misconduct, or personal injury, nor deprives consumers of mandatory legal guarantees.

Neither party shall be held liable for a failure resulting from an event of force majeure within the meaning of article 1218 of the French Civil Code.

The website may contain links to third-party sites over which Elinora Luxury Real Estate exercises no control. No responsibility is accepted for their content, security or privacy practices.

These terms may be amended at any time. The version applicable to your visit is the one published on the website at that date.

If any provision of these terms is held void or unenforceable, the remaining provisions shall remain in full force.

Computerised records kept under reasonable security conditions are admissible as evidence of exchanges made through the website.

Any complaint may be addressed to contact@elinoraluxuryrealestate.com. Failing an amicable solution, consumers may refer the matter free of charge to the consumer mediator ANM Conso, 62 rue Tiquetonne, 75002 Paris — www.anm-conso.com.

These terms are governed by French law. Any dispute falls within the jurisdiction of the courts of Paris for professionals; consumers retain the benefit of the protective jurisdiction rules of article R.631-3 of the French Consumer Code.
